Terms of Service

1. Acceptance of these terms

These Terms of Service are a binding agreement between you and Youmus regarding your use of the Youmus mobile apps, the youmus.app website, and any related services (together, the "Service"). By creating an account, uploading a track, listening, or otherwise using the Service, you agree to these terms. If you do not agree, do not use the Service.

These terms work alongside our Privacy Policy, which explains what we collect and why. Please read both.

2. Who can use Youmus

You must be at least 16 years old to use Youmus. If your country sets a higher minimum age for online services or for consent to data processing, that higher age applies to you. By using the Service you confirm that you meet this requirement.

You must give accurate information when you sign up and keep it current. One person gets one account. Creating multiple accounts to farm ears, evade limits, inflate charts, or get around a suspension is not allowed and is grounds for termination.

3. Your account

You are responsible for keeping your login credentials safe and for everything that happens under your account. Do not share your account or let anyone else use it. Tell us promptly at support@youmus.app if you believe your account has been accessed without your permission.

You may close your account at any time. Some records — for example ledger entries required for integrity and accounting — may be retained as described in our Privacy Policy and as required by law.

4. Your content and the licence you grant

You keep ownership of the tracks, voice memos, artwork, text, and other content you upload ("your content"). We do not claim any ownership of your music.

To run the Service, you grant Youmus a limited, worldwide, non-exclusive, royalty-free licence to host, store, reproduce, transcode, stream, and display your content, and to create derivative formats such as compressed previews and waveforms, solely to operate, improve, secure, and promote the Service. This licence lasts only as long as your content is on the Service, plus a short period to complete removal from backups and caches.

You must own your content or have all rights and permissions needed to upload it and grant this licence — including rights to any samples, beats, vocals, collaborators' parts, and master and publishing interests. Youmus celebrates rough, unfinished demos, but demo culture is never an excuse to upload work that is not yours. 5. Acceptable use

Use Youmus in good faith. You agree not to upload content that infringes intellectual property, that is unlawful, or that harasses, threatens, defames, or promotes hate against any person or group. You agree not to spam, scrape, or post sexual content involving minors or other prohibited material.

The honesty of Youmus depends on real listening. You agree not to use bots, scripts, emulators, automation, or any other technique to fake or pad listens, farm ears, inflate the ear score, or manipulate the charts. Feedback you give must be your own honest reaction — buying, selling, or coordinating fake feedback is prohibited.

6. Ears and youms

Youmus uses two clearly separated currencies. Ears are earned-only reciprocity credits: you earn one ear for each verified listen you give, and an ear pushes one of your tracks into someone else's deck. Ears have no cash value and can never be bought, sold, transferred between accounts, gifted, or redeemed for money. This is the core promise of the product and we enforce it strictly.

Youms are a prepaid convenience currency you buy with money through Apple, Google, or Stripe. Youms buy speed and visibility only — for example deck boosts, super-likes, spotlight placements, extra track slots, or pro analytics. Youms never buy ears, reactions, guaranteed feedback, or a guaranteed chart position. Spotlight placements are clearly labelled as ads and are never inserted into the earned chart rankings, which are described in section 8.

Youms have no cash value, are not legal tender, and cannot be exchanged for money. There are no payouts to creators. Purchases are generally final and non-refundable except where a refund is required by law or by the rules of the app store or payment processor you used. Prices, pack sizes, and what a given youms feature does may change over time; changes apply to future purchases. For details on payment data, see our Privacy Policy.

7. Listen verification and fair play

A swipe only counts after a verified listen — at least 30 seconds or at least half of the track — confirmed server-side from playback heartbeats. We verify listens to keep the reciprocity fair; the server, not the client, decides whether a listen counts.

Attempting to circumvent listen verification, spoof heartbeats, or otherwise farm ears may result in forfeiture of affected ears, removal of the related listens, results, and chart contributions, and suspension or termination of your account. We may apply these measures retroactively when manipulation is detected.

8. Charts and reputation integrity

Weekly per-genre charts are computed server-side from verified listens and saves and reset every Monday so new tracks always have a fresh shot. The tastemaker role and the public ear score are earned from verified activity — listening volume, feedback helpfulness, and early detection of tracks before they chart — and are never sold or assigned at signup.

We may recompute, correct, withhold, or remove any chart position, ear score, or reputation signal that we reasonably believe was manipulated or produced by activity that violates these terms. Our integrity decisions are made to protect honest makers.

9. Moderation, suspension and termination

We may review content and activity to enforce these terms and keep the community safe. We may remove or restrict content, limit features, or suspend or terminate accounts that violate these terms, harm other users, or expose Youmus to legal risk. Where it is reasonable and lawful to do so, we will tell you why.

You may stop using Youmus at any time. Sections that by their nature should survive — including content licences already granted, the ears and youms rules, disclaimers, limitation of liability, and indemnification — survive termination.

10. Third-party services

Youmus relies on third parties such as Apple's App Store, Google Play, and our payment processor Stripe. Your use of those services is governed by their own terms and policies, and purchases made through an app store are also subject to that store's rules, including its refund process. We are not responsible for third-party services we do not control.

11. Disclaimers

The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure, or that any particular amount of feedback, listens, or exposure will result from using it.

12. Limitation of liability

To the maximum extent permitted by law, Youmus and its officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, goodwill, opportunities, or anticipated exposure arising from your use of the Service. To the extent liability cannot be excluded, our total liability to you for all claims is limited to the greater of the amount you paid Youmus in the twelve months before the claim or fifty US dollars.

13. Indemnification

You agree to indemnify and hold harmless Youmus from any claims, damages, liabilities, and reasonable expenses, including legal fees, arising out of your content, your use of the Service, your violation of these terms, or your infringement of the rights of any third party.

14. Changes to the service and to these terms

We are actively building Youmus, so features may be added, changed, or removed over time. We may also update these terms. When changes are material, we will take reasonable steps to notify you — for example, in the app or by updating the date above. Your continued use of the Service after changes take effect means you accept the updated terms; if you do not agree, please stop using the Service.

15. Governing law and dispute resolution

These terms are governed by the laws of the jurisdiction in which Youmus is established, without regard to its conflict-of-laws rules, except where mandatory consumer-protection laws of your country of residence apply. Before starting any formal proceeding, please contact us at legal@youmus.app so we can try to resolve the matter informally. Any disputes that cannot be resolved this way will be handled by the competent courts of that jurisdiction, subject to any rights you have under local law.
